Public holidays have varying rules so it can be confusing with all the different situations that can occur based on your business and employee situations. To help we have mapped out four common public holiday payroll scenarios for you to refer to if any of these arise with your employees.
Scenario one:
The public holiday falls on a day when your business decides to open.
Scenario two:
The public holiday falls on a day when your business is usually open but decides to close.
Scenario three:
The public holiday falls on a weekend but your business hours are weekdays only. This means the public holiday is observed and will be Mondayised.

An employee has decided to take leave on a public holiday.

Here are our most asked public holiday payroll questions.
No, all banks will be closed. MBIE advise that employment agreements should contain a clause stating that if a pay day falls on a public holiday, the employee will be paid either before or after the public holiday. If it's not in their employment agreement, then you should pay your employee before the public holiday so they are not disadvantaged.
Because your employee would have normally worked on these days, but can’t because your business is closed, they are entitled to be paid their normal daily pay. This should be recorded as a Statutory Holiday Taken in Smartly.
Your employee must be paid at least time and a half for the hours they work. This should be recorded as a Public Holiday Worked in Smartly. This employee is not entitled to receive an alternate public holiday.

No, casual employees have the same entitlements as permanent employees. For example, if your casual employee works on ANZAC Day, they're entitled to be paid at least time and a half. If this is a day they would normally work, they are also entitled to earn an Alt Public Holiday.
Contractors are not entitled to be paid for public holidays by their employer, because they are deemed to be self-employed. Sometimes an employer may have a special arrangement with their contractor to pay them for public holidays.
If your employee is on annual leave when there is a public holiday, they are entitled to be paid for the public holiday instead of taking annual leave.
Easter Sunday is not a Public Holiday. If your business is closed (and it's a normal working day for your employee) you may give that employee the option of taking Annual Leave or Leave Without Pay. Remember, you can't insist on an employee taking Annual Leave without giving 14 days' notice.
ANZAC Day is a restricted trading day. This means that you can only trade after 1pm, and your employees can only work from this time. There are some exemptions, and we recommend getting in touch with MBIE if you have any questions.
